1. Purpose

JouBook is an online (SaaS) platform for managing appointments, payments, and clients, designed for professionals. By using the service, you fully accept these terms.

1 bis. Excluded use cases

JouBook is intended for professionals in wellness, coaching, consulting and legal services. The service must not be used to store health data within the meaning of GDPR Article 9 (medical records, diagnoses, prescriptions, lab results, mental-health notes, etc.) nor to carry out any regulated medical, paramedical or clinical-psychology activity (medicine, nursing, clinical psychology, physiotherapy, etc.). The user is solely responsible for the content they enter and agrees not to upload any such data. Any breach of this clause may result in immediate account termination without refund.

2. User account

You are responsible for keeping your credentials confidential and for all activity carried out from your account. You agree to provide accurate information and keep it up to date.

3. Subscription

Access to the service is provided as a monthly or annual subscription, billed in advance and renewed automatically. You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.

4. Pricing

Current pricing is shown on our Pricing page. Any change will be notified at least 30 days before taking effect.

5. Availability

We strive to maintain 99.5% uptime. Service interruptions may occur for maintenance and will be announced whenever possible.

6. Liability

JouBook shall not be liable for indirect damages arising from the use of the service. Our liability is capped at the amounts paid during the previous 12 months.

7. Termination

You may terminate at any time. In the event of a serious breach, we reserve the right to suspend or close your account.

8. Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles. Subject to Section 9 below, the state and federal courts located in Sheridan County, Wyoming shall have exclusive jurisdiction over any dispute not subject to arbitration.

9. Binding arbitration & class action waiver

PLEASE READ CAREFULLY — THIS SECTION AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim or controversy arising out of or relating to these Terms or the use of the service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Sheridan, Wyoming (or remotely, at the user's option), in English, before a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.

CLASS ACTION WAIVER. You and JouBook agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

30-day opt-out. You may opt out of this arbitration agreement by sending written notice to legal@joubook.com within 30 days of first accepting these Terms. Small-claims court actions and equitable/injunctive relief for intellectual-property infringement are excluded from this section.

EU / UK / Canadian users: nothing in this section limits any mandatory consumer rights granted to you by the laws of your country of residence.
